The President has signed Law No. 11315, which cancels the “freezing” of limitation periods during martial law.
What does this mean?
Previously: the limitation period stopped running during the war.
Now: the deadlines for filing claims continue to run despite martial law.
Example:
You had 3 years to file a lawsuit.
1 year passed before the war.
You “had” 2 more years after it ended.
Now those remaining 2 years are running right now.
Why was this changed?
– To protect potential defendants from overdue (delayed) claims.
– To reduce the workload on courts.
It is expected that the changes will ensure a balance between preventing abuse and maintaining access to justice. Whether this balance will be achieved — time will tell.
