LBASE PROTECTED AN ELECTRIC VEHICLE IMPORTER FROM UAH 1.5 MILLION IN TAX PENALTIES
LBASE successfully defended the interests of its client a leading domestic importer of electric vehicles to Ukraine against unlawfully imposed tax penalties for alleged violations of currency regulations.
Our client imported electric vehicles to Ukraine. During customs clearance, a mistake was made by the customs broker — a different foreign economic contract was submitted for customs processing. As a result of this error, certain payments remained unclosed, preventing the bank from terminating currency supervision of the contract. Consequently, the tax authority conducted an unscheduled audit of compliance with currency regulations during the import operations and charged our client a penalty of approximately UAH 1.5 million.
The LBASE team analyzed the client’s documentation, developed a solid legal position to protect the client’s interests, prepared objections to the tax audit report, and represented the client at the commission hearing reviewing the objections.
Thanks to a properly and most importantly, timely developed defense strategy, the tax authority that conducted the audit took our objections into account and canceled its audit results!
