LBASE TEAM ACHIEVES SUCCESS FOR CLIENT IN TAX DISPUTE WORTH UAH 100 MILLION

The tax authority conducted an audit of the Client and assessed additional tax liabilities totaling UAH 100 million.

Disagreeing with this assessment, the Client filed a lawsuit challenging the tax authority’s decisions. The court of first instance ruled in favor of the Client and annulled the tax authority’s decision.

The tax authority, dissatisfied with this outcome, filed an appeal. The appellate court partially satisfied the appeal, overturned the first-instance court’s decision, and dismissed the Client’s claim.

The LBASE team took over the case at the stage of cassation review. As a result of our team’s work, the Supreme Court upheld the Client’s cassation appeal, annulled the appellate court’s decision, and remanded the case for a new consideration by the appellate court.

Upon reconsideration, the Sixth Administrative Court of Appeal rejected the tax authority’s appeal and upheld the decision of the court of first instance, which annulled the tax authority’s assessments.

Thus, the appellate court confirmed the validity of the Client’s claim to cancel the tax notices and decisions regarding additional tax liabilities totaling UAH 100 million.
